Contre le piratage des photos

La photographie est, au même titre que la musique, une œuvre de l’esprit protégée par les droits sur la propriété intellectuelle. En conséquence de quoi l’utilisation, même à usage privé, de photographies « volées » sur Internet est un acte passible de poursuites judiciaires. L’utilisation de photographies à titre privé, scolaire ou professionnel pour l’illustration de documents, de rapports, de sites web, d’articles de presse, de publicités, de plaquettse etc. sur quelque support que ce soit est donc soumise à la législation sur les droits d'auteur. Les particuliers ne sont pas les seuls visés par les problèmes de piratage puisque certaines entreprises utilisent de la photographie librement pour la rédaction de leurs supports de communication externes ou internes.
Cette utilisation frauduleuse, qu'elle soit consciente ou non, peut s’expliquer par différentes raisons. La première de ces raisons est la malheureuse ambiguité du terme Libre de droit. La mention libre de droit, souvent associée à photo gratuite, ne signifie certainement pas que l’utilisation est exempte de droit. Ce terme s’oppose simplement au terme à droit géré et spécifie que l’acquéreur de la licence d’exploitation de la photographie peut utiliser celle-ci pendant un temps donné et autant de fois qu’il le souhaite sur les supports qui lui conviennent dans les limites définies par cette licence. L’acquisition de cette licence libre de droit n’est pas gratuite et celle-ci doit définir, en particulier, les conditions d’utilisation et de diffusion de l’œuvre ainsi que celles relatives à la rémunération de l’auteur.
Une des raisons expliquant ce piratage de photos peut aussi être imputée au prix important des photos libres de droits sur les banques d’images traditionnelles. Le prix de ces photos peut atteindre plusieurs centaines d’euros selon la résolution souhaitée. Cette charge est lourde pour une PME pour laquelle le coût des photos d’une plaquette pourrait alors largement dépassé le coût de l’impression par exemple. La barrière prix est ainsi le principal obstacle à utilisation légale de photographies et ceux aux dépends de leurs auteurs.
La solution pour l’industrie musicale dans la lutte contre le téléchargement pirate de musique est la baisse sensible du prix par la création de plateformes en ligne proposant le morceau à un faible prix. Les profits sont peut être moins importants mais ils sont compensés par la vente en plus grand nombre. Pour les photographies, Fotolia propose aussi une solution originale sous la forme d’une place de marché en offrant d’une part aux clients des prix défiant toute concurrence, jusqu’à 10 fois inférieurs à ceux du marché, et permettant d’autre part de rémunérer les photographes dignement. Fotolia est une place de marché permettant aux professionnels et aux particuliers de vendre et d’acheter de la photographie libre de droit. Les photographes amateurs comme professionnels peuvent venir déposer leurs meilleurs clichés et pour chaque photo vendue, il touche alors des droits d’auteur équivalent à 50 % du prix de vente. L’argument prix n’étant alors plus recevable et chacun ayant accès à ces photos, le « vol » de photos n’est alors plus justifiable.
